You shall affirm that you are more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Use, and to abide by and comply with these Terms of Use.

You agree that you have provided true, accurate, current and complete information to the Company in connection with any use or access of the Service.

In case a user is entering into a Contract on behalf of an Organization, the user represents that he is authorized to act on behalf of the Organization.

In the event the user is accessing the service to digitally sign documents using their Aadhaar Card, the user should ensure that they are in physical possession of the Registered Mobile Number registered with the UIDAI. The possession of the Registered Mobile Number is mandatory in order to get the One Time Password required to digitally sign the document.

The Platform provides automated software solutions to Users who desire to create legal agreements or require a detailed vetting or summary of an agreement.

The Agreement Library is an automated option to draft agreements with the help of templates already provided on the Platform. The drafted agreement shall be available in your dashboard for downloading or e-signature immediately on the payment of the applicable fee.

The Company has developed a technology platform and built a software application that integrates eSign API as per the eSign API Specifications issued by the Controller of Certifying Authorities.

Users can use Lex-Sign.com to upload documents in PDF format and apply electronic signatures in the modes and means provided on the platform.

The Platform provides facility to request Stamp Paper or eStamp certificate and merge the same with agreements uploaded by the User.

In order to access the Service, you may be required to provide information about yourself including your name, email address, username, and password. You agree that any registration information you give will always be accurate, correct and up to date.

You must not share your account or password with anyone. You should notify the Company immediately of any breach of security or unauthorized use of your account.

The Company shall not be liable for any losses caused by any unauthorized use of your account.

The Company's Privacy Policy is available at lex-sign.com/privacy-policy and is incorporated into these Terms of Use by reference. Please review the Privacy Policy, which governs the Site and informs users of the Company's data collection practices.

The Company owns all intellectual property rights (including copyright, patents, database rights and trade marks, whether registered or unregistered) to and in the Service.

Subject to your compliance with these Terms of Use, the Company grants you a limited, non-exclusive, non-transferable, personal licence to access and use the Service.

You shall not copy, modify, create a derivative work of, reverse engineer, decompile or otherwise attempt to extract the source code of the software underlying the Service or any part thereof, unless expressly permitted or required by law.

The Company does not provide a refund once the payment is made for a subscription plan.

Monthly subscriptions: Subscription fees are non-refundable.

Annual subscriptions: Users can switch plans but cannot claim a refund for the remaining period.

Service credits once consumed (i.e., eSign or eStamp transactions completed) are non-refundable.

Each user is provided with cloud storage as per their subscription plan for storing documents.

The Company reserves the right to delete documents stored in your Drive after 90 days of account inactivity (no login, no document activity).

Users are responsible for maintaining their own backups of important documents.

The Company shall not be liable for loss of documents due to account inactivity or expiry.

All payments must be made through the payment methods available on the Platform.

All prices are exclusive of applicable taxes unless otherwise specified. GST at the prevailing rate (currently 18%) is applicable on all services.

The Company uses third-party payment processors and is not responsible for any errors or failures in payment processing.

The Aadhaar eSign service is provided in collaboration with C-DAC and UIDAI (Unique Identification Authority of India). The Company acts as an Application Service Provider (ASP) and is licensed to offer eSign services through the NSDL (National Securities Depository Limited) certifying authority.

The Company does not store Aadhaar numbers. Aadhaar-based authentication is performed directly by UIDAI and the certifying authority.

The Company cannot guarantee uninterrupted availability of the Aadhaar eSign service as it depends on UIDAI infrastructure.

The following documents cannot be executed through Aadhaar eSign: (a) Negotiable instruments other than cheques, (b) Power of Attorney, (c) Trust documents, (d) Wills and testamentary dispositions, (e) Contracts for sale or conveyance of immovable property.

The Service is available in India only and is subject to applicable Indian laws.

The Company reserves the right to modify, suspend or discontinue any part of the Service at any time without notice.

You agree not to use the Service for any unlawful purpose or in any way that violates these Terms.

You shall not upload any content that is defamatory, obscene, fraudulent, or infringes the intellectual property rights of any third party.

You are solely responsible for the content of documents uploaded to the Platform.

You agree to comply with all applicable laws, rules, and regulations in connection with your use of the Service.

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Service.

The Company's total liability to you for any claim arising from these Terms shall not exceed the amount you paid to the Company in the 30 days preceding the claim.

You agree to indemnify, defend and hold harmless the Company, its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

The Company reserves the right to terminate your access to the Service at any time, for any reason, without notice.

You may terminate your account at any time by contacting us at [email protected].

Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination shall survive.

You may request deletion of your account by contacting [email protected].

Upon deletion, your personal data will be removed as per our Privacy Policy, subject to legal retention requirements.

Documents signed using the Service may be retained in the audit trail as required by law.

These Terms shall be governed by and construed in accordance with the laws of India.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
